BOARD OF HEALTH MEETING MINUTES
June 14, 2010
The meeting opened at 6:30 p.m. Lisa Cullity, Chair, Elizabeth Cytrynowski, Clerk, and Tom Driscoll, member, were present. The Board reviewed correspondence. signed payroll. septic permits and accounts payable vouchers. Cytrynowski moved to approve May 10, 2010 minutes, Driscoll seconded, all in favor.
Regular meeting closed and public hearing meeting opened.
11 Furnace Road-variances. John and Lori Moore, residents / abutters at 8 Ames Way in attendance; Steve Rumba, Collins Engineering, presented variance requests as follows:
1. Variance in accordance with DEP policy allowing a percolation rate to be established via grain size distribution analysis
2. Variance allowing a reduction from 20’ to 11’ setback from a foundation wall to a leaching facility
3. Variance allowing a reduction from 5’ to 4’ separation between the high ground water elevation and the bottom of the soil absorption system with a percolation rate less than 2 minutes per inch
4. Variance allowing a reduction from 200’ to 78’ setback from a tributary to a surface water supply to a soil absorption system
5. Variance allowing a reduction from 200’ to 84’ setback from a tributary to a surface water supply to a septic tank
6. Variance allowing a reduction from 200’ to 90’ setback from a tributary to a surface water supply to a pump chamber
7. Variance for a reduction of design flow from Town Board of Health bylaw of 150 gpd per bedroom to110 gpd per bedroom. This variance required due to space limitation and to maintain suitable driveway width.
Rumba stated he would be using a Presby System as it was better at removing particulate from water. Moore has well sited only 45’ from system. Cullity asked Rumba if it was possible if he could move the system to get a 50’ separation. Moore stated that 11 Furnace Road has town water and asked if the system could be relocated to the other side of that property. Rumba said he would see if the plans could be redesigned for a relocation. Cullity said to check on other wells in the area and to keep a minimum 50’ separation.
Public hearing closed and the regular meeting reopened at 6:48 p.m.
Tony Marino, Building Inspector, 15 Olive Avenue condemnation. Although the septic has failed and the house has been deemed uninhabitable, the Building Department has postponed their condemnation hearing to a later date.
Tom Fleming, 36 Taylor Point Road. The septic system is in failure and must be replaced. The current drinking well is too close to the septic system and a new one must be re-drilled in another part of the property. As there is no Town water on the street, the owner is concerned about the well installation being completed at the same time as the new septic installation since the original well driller backed out. Cullity suggested he install the new system right away with the old well in its current location and allow 3 months to get the new well installed at the new location. At that time, if the new well is not in place, Fleming must return to the Board for further consideration. Cytrynowski made the motion that he install the new system right away with the old well in its current location and allow 3 months to get the new well installed at the new location. Vicky Dougherty, 204 Center Street. Discussed with the Board the issue of Title 5 inspections at the condos at the above address. Dougherty stated that the 15 units have been built in sections over the past 3 years. A Title 5 was recently done on all 15 units recently even though less than 3 years have past on a lot of the units. Cullity said that although it is mandatory for condos to be Title 5 inspected every 3 years (at 2 years if the unit(s) are sold), she felt it was unnecessary that all of them had to be inspected at this time. Cullity also suggested working with the condo association and perhaps using the recent Title 5 inspections as the 3-year base for future inspections.
45 Pine Tree Lane—variance request: a reduction of soil absorption system from seasonal high grown water from 4’ to 3’. Cytrynowski moved to allow the variance; Driscoll seconded. All in favor.
223 Pelham Street—variance request: a reduction of soil absorption system from seasonal high grown water from 4’ to 3’. Cytrynowski moved to allow the variance; Driscoll seconded. All in favor.
Septic permits approved by the Board: 17 Cardinal Way, 7 Marion Way, 174 Plymouth Street, 38 Taylor Point Road (upon DEP approval), 45 Pine Tree Lane and 223 Pelham Street.

85 Mattakeesett Street letter regarding making changes to the building without a permit. Driscoll moved that the Board talk with Tony Marino, Building Inspector; Cytrynowski seconded. All in favor.·

The Board approved a tight-tank install at 38 Taylor Point Road; DEP to be informed.·
For the purpose of presenting a proposal to the Town Administrator, the Town Clerk asked that the Board approve the office to be closed on the Tuesday evenings after a Monday holiday. The Board agreed.Cytrynowski moved to adjourn at 8:05 p.m.; Driscoll seconded. All in favor.
