BOARD OF HEALTH MEETING MINUTES
November 9, 2009
The meeting opened at 6:36 p.m. Lisa Cullity, Chair, Elizabeth Cytrynowski, Clerk, and Scott MacInnes, Member, were present. The Board reviewed correspondence, approved minutes, signed payroll, septic permits and accounts payable vouchers.

Memo re: budget cuts meeting on Friday, November 20, with department heads.·
November and December meeting dates: November 23, December 7, and December 21.·
Variance for septic system at 46 Plymouth Street. Local upgrade approval from required four (4) foot ground-water separation to three (3) feet. This variance eliminates the requirement for a pump system. MacInnes moved to approve, Cytrynowski seconded. All in favor.
Jim Traynor, 23 Cypress Road -- wants to have access to metal dumpster at the recycling center. Cullity explained about Town liability issue. Cullity stated she’d find out about the Town insurance policy and perhaps have him sign a hold-harmless waiver. Traynor stated that if one person is allowed to do it, everyone will have to be allowed to do it. Traynor also stated that the recycling “boss” takes things out of the dumpster, but the Board claimed none of them have seen that happen.

Shayne McGlone re: 54 Alvern Road – Public hearing. No one else appeared. Variances requested: (1) reduction in the setback of SAS to surface water supply from the required 200 feet to 66 feet; (2) reduction in the setback of tank to surface water supply from the required 200 feet to 56 feet; (3) reduction in the setback of SAS to property line from the required 10 feet to 5 feet; (4) reduction in the setback of septic tank to property line from the required 10 feet to 5 feet; (5) reduction in the setback of septic tank to cellar wall from the required 10 feet to 5 feet; (6) reduction in the setback of SAS to cellar wall from the required 20 feet to 6.5 feet; and (7) allow leaching to be sized using Title V’s 110 gpd / bedroom from the Town’s required 150 gpd to 110 gpd. MacInnes moved to approve; Cytrynowski seconded. All in favor.

Reopened regular meeting at 7:20 p.m.
Bondo Benjamin, 7 Taylor Street and Carl Catani, 49 Cross Street – hot dog stand at Rt. 139 and Cross Street. Cullity voiced the Board’s concerns about problems with flies as the stand is in close proximity of the horse farm and how difficult and important it is to keep the area clean, everything will have to be covered at all times and hand washing is imperative. Cullity stressed they must be proactive and diligent about cleanliness. The business will operate for 6 months from May to November. Cullity stated they may move forward with the permitting process.
Vincent Flaherty, 205 West Elm Street – present at meeting and recognized by the Chair. Flaherty had concerns about: (1) Blueberry Lane septic systems. Flaherty wants a mandate for corrective action for the septic systems that sit in groundwater. Cullity explained that the Blueberry Lane Association has been given a time-frame to address the septic issues. (2) Board of Health agenda closing time. The Board explained again to Mr. Flaherty that it is necessary to have a cut-off time (Thursday prior to meeting at 3:00 p.m.) in order to review agenda and make any necessary preparations for the meeting. (3) Recycling center manager’s title -- Flaherty claims Mr. Valenti’s title was changed from supervisor to manager. Cullity stated that he does both positions. Flaherty requested the withdrawal of Mr. Valenti from the position. Cullity and the Board explained how Mr. Valenti did a great job in time and cost savings and acquiring the necessary contracts and permits for the moving and opening of the new recycling center. (3) The closing of the landfill – Flaherty thinks it’s a waste of time and money. Cullity stated that the closing is DEP mandated and gas and water testing is mandatory at the closure site. She also stated that, once again, Mr. Valenti saved the Town money by firing the past engineering company and hiring the new one at a more reasonable cost. (4) Items left outside of bins at recycling center during business hours – they can be taken by residents if needed but they will be tossed into the bins at the end of the business day per DEP.
MacInnes moved to adjourn at 7:45 p.m., Cytrynowski seconded. All in favor.
