BOARD OF HEALTH MEETING MINUTES

The meeting opened at 6:35 p.m. Lisa Cullity, Chair, Elizabeth Cytrynowski, Clerk, and Scott MacInnes, Member, were present. The Board reviewed correspondence, approved minutes, signed payroll, septic permits and accounts payable vouchers.

Theresa Damien, student at Regis College, observed the meeting as per college assignment.

The Board voted to extend perc tests at 105 Congress Street and Canoe Club.

Discussion about the Board of Health empowering the Board of Selectmen to enter into contracts for solid waste, landfill capping and recycling and that the Town Administrator be responsible for the day-to-day operation of the recycling center and landfill capping operation and the respective employees and that the Board of Selectmen assume responsibility for setting trash rates. The Town Administrator will continue to oversee and direct the Board of Health employees. This is to be effective immediately. MacInnes moved to give full authority, Cytrynowski seconded. All in favor.

Richard Iacobucci, 172 Washington Street—complained that his fireplace ashes are no longer being picked up at curbside by the current hauler. Cullity explained that the DEP has a ruling that they cannot be collected. Cytrynowski mentioned that the ashes are good for the garden and perhaps that would be a good way to recycle them.

Alan and Nancy Gilmartin, 114 Plain Street –also present: Nancy and Cliff Walent, 118 Plain Street, Katie Dinardo, 115 Plain Street and Janine Tuley, 111 Plain Street. Appeared before the Board to complain about their neighbor’s manure storage on the property line of the Gilmartin’s. Cullity explained that although the neighbors have a right to have horses and store manure on their property, they cannot store it on the property line and will notify resident of same. Cullity stated she’d send the Health Agent to the property to ensure the manure is not a nuisance. The parties were also concerned about the number of horses the resident may acquire in the future, the trailer traffic it may cause, as well as flies and odor. Cullity asked if the Planning Board, Conservation Commission or ZBA issued any restrictions or special conditions for the property.

Vincent Flaherty, 205 West Elm Street Blueberry Lane--Asked the Board about the septic systems. Cullity stated she has not had contact with the Association since his last request, that no action has been taken. Recycling Center--Flaherty went on to request information regarding the construction, costs, who was hired to do said construction and especially focused on the manager of the recycling center. MacInnes motioned to have the Secretary get all that information. That motion was not seconded. As Flaherty has been before the Board on several previous occasions regarding the recycling center manager, Cytrynowski asked Flaherty what his “obsession” was with the recycling center manager. Flaherty stated he felt the manager’s salary was too high and then he admitted that he wanted to find out if there were “hook ups” between the involved parties regarding the recycling center.

Cullity called him on that accusation of ”hook-ups” and said she was offended by that accusation. Flaherty heatedly argued and denied he said that; Cullity responded to Flaherty’s denial by offering to replay the tape immediately so he could hear himself say it. Cullity stated that the manager is very qualified, was and is doing an excellent job, his salary is justified, that all contracts went to bid and were legally awarded. Cytrynowski told Flaherty she finds his pursuit and accusations towards the recycling manager very bizarre. Cullity said she’d get the requested information herself and told Flaherty that as of this date, the Board of Health is no longer in charge of the recycling center and that any further concerns should be addressed to the Town Administrator.

Scott Gagnon, 23 Blackbird Drive—requested that his trash bill be abated as his house was in construction the first half of fiscal 2010. Cytrynowski moved to abate the trash bill, MacInnes seconded. All in favor.

Government Study Committee—Tony Marino, George Emanuel, Pete Isham, Bill Buckley, members of the committee, were present. They made a presentation to the Board regarding an act establishing a Town Manager form of government for the Town of Pembroke. They discussed the responsibilities of Town Manager vs the current position of Town Administrator and the effectiveness of such. This discussion was solely for information purposes only.

Cytrynowski moved to adjourn at 7:55 p.m.; MacInnes seconded. All in favor.
